SpeechNow.org v. FEC – Federal Court Strikes Contribution Limits To Independent Expenditure Groups

The U.S. Court of Appeals for the D.C. Circuit released its opinion this morning in SpeechNow.org v. FEC.  The court held that the contribution limits applicable to committees engaging solely in independent expenditures violate the First Amendment, but upheld the disclosure, registration and organizational requirements.  This means that such groups will be required to register and file periodic reports with the Federal Election Commission (“FEC”).  Both SpeechNow.org and the FEC are reviewing the decision.  There is no word if either party intends to appeal the decision to the United States Supreme Court.
